Mitchell was arrested in Bowraville on the morning of June 8 in relation to the death of a nine-month-old girl who was found unresponsive when emergency services were called to a home in Binnaway in 2018.

The baby was taken to Coonabarabran Hospital, where, despite the efforts of medical staff, she died a short time later.

The circumstances surrounding the death have been under investigation by detectives from Orana Mid-Western Police District, under Strike Force King.

After obtaining new information, strike force officers executed a crime scene warrant at a Binnaway home on May 31, 2023.

Further inquiries saw detectives arrest the 37-year-old on June 8. He was taken to Macksville Police Station and charged with murder.

Mitchell, who appeared on X-Factor and placed seventh in 2011, was refused bail when he appeared at Macksville Local Court following his arrest.

Mitchell Calloway’s lawyer set to make application for bail

Defence lawyer Neil Smith told Coffs Harbour Local Court on June 13 that he had a “bundle of material” to present in a bid to secure freedom for Mitchell.

Magistrate Julia Virgo asked whether Mitchell would be required to appear in person for a release application.

Mr Smith said Callaway would need to appear in court, to which the Magistrate said she needed time to read the material presented to the court.
